2. PURPOSES OF PROCESSING

We process the data you provide to us for the following purposes:
  • To respond to your information requests and enquiries submitted through the forms.
  • To manage the schedule of assessments and the care relationship with the minor.
  • To provide the contracted neurorehabilitation services.
  • To comply with the legal obligations applicable to a healthcare centre.

3. LEGAL BASIS

  • The explicit consent of the data subject or their legal representative (Art. 6.1.a and Art. 9.2.a GDPR) for data provided through the forms, including health data.
  • The performance of a contract or pre-contractual measures (Art. 6.1.b GDPR) when you contract our services.

4. SPECIAL CATEGORIES OF DATA: HEALTH DATA AND MINORS

The centre provides services to minors and may process data related to their health. Such data is considered a special category of personal data under Article 9 of the GDPR and is subject to enhanced protection.

Consent for the processing of this data must be given by the child’s father, mother, or legal guardian. In Spain, a minor’s own digital consent is only valid from the age of 14, in accordance with Article 7 of the LOPDGDD.

5. RECIPIENTS AND DATA PROCESSORS

We do not transfer your data to third parties unless required by law. In order to provide our services, we may use data processors, such as a web hosting provider, email service provider, form management provider and, where applicable, clinical management software provider. We enter into the required agreements with these providers in accordance with Article 28 of the GDPR.

We ensure that the hosting and processing of data are carried out within the European Economic Area (EEA).

6. DATA RETENTION PERIODS

Enquiries that do not result in a care relationship are retained for the time necessary to respond to them and, in any case, for no longer than 12 months.

Clinical documentation is retained in accordance with Law 41/2002, for a minimum period of 5 years from the end of each care process.

7. RIGHTS OF DATA SUBJECTS

You may exercise your rights of access, rectification, erasure, objection, restriction of processing and data portability, as well as withdraw your consent at any time, by writing to ameli.centro.bcn@gmail.com. If you believe that the processing of your data does not comply with applicable regulations, you may lodge a complaint with the Spanish Data Protection Agency: (www.aepd.es).

8. AUTOMATED DECISION-MAKING AND PROFILING

We do not make automated decisions that produce legal effects concerning you or significantly affect you, nor do we carry out profiling using your data, in accordance with Article 22 of the GDPR.
